1) in considering whether a confiscation order is oppressive and an abuse of process the court must also consider whether it is proportionate under A1P1 consonant with D’s right to the peaceful enjoyment of his possessions.
2) “just satisfaction” is only available to D, under article 41 ECHR, for a violation of his human rights where there is a proximate causal link between the procedural violation found and D’s financial loss.
